US Federal Court Bars RIM (BlackBerry) from Using BASIS’ BBX Trademark   [TOP]
ALBUQUERQUE, N.M.--(BUSINESS WIRE)--The United States Federal Court in Albuquerque today granted a temporary restraining order (TRO) against Research in Motion (RIM), immediately barring RIM from using BASIS International Ltd.’s incontestable federally registered BBX trademark at RIM’s Asian DevCon on December 7-8 in Singapore. “despite the fact that the two companies are not direct competitors, the parties’ respective BBX products are highly related and target the same class of consumers, that is, business application software developers (TRO page 9).” RIM had refused BASIS’ requests to stop the infringement at the DevCon conference, which resulted in BASIS filing for the TRO. In rejecting RIM’s arguments against the issuance of a TRO, the court found that, “The BBX mark is identical to the mark which RIM is allegedly using to present its BBX product (TRO page 8).” and “despite the fact that the two companies are not direct competitors, the parties’ respective BBX products are highly related and target the same class of consumers, that is, business application software developers (TRO page 9).” The court went on to concur with BASIS that “The alleged infringement is likely to cause customers and prospective customers to wrongly believe that the software applications created using BASIS’s development tools are only compatible with RIM’s BBX operating system (TRO page 11).” The order described how the “Courts use a well-established four-part test to decide whether to grant injunctive relief (TRO page 7)” and concluded that “Accordingly, after considering all the factors relative to a determination of whether an injunction should be granted, the Court finds that all factors weigh in favor of BASIS (TRO page 8).” See BASIS’ latest generation of BBX in action by running the sample restaurant tip calculator and home mortgage calculator applications from links.basis.com/buidemos to experience BASIS’ BBX platform-independent solutions on your own smartphone or tablet.

BASIS Files Motion for a Temporary Restraining Order Against RIM’s Use of BBX   [TOP]
December 01, 2011 09:31 PM Eastern Time BASIS Files Motion for a Temporary Restraining Order Against RIM’s Use of BBX ALBUQUERQUE, N.M.--(BUSINESS WIRE)--BASIS International Ltd. yesterday filed a motion for a temporary restraining order barring Research in Motion (RIM) from using BASIS’ incontestable federally registered trademark “BBX” at RIM’s Asian DevCon in Singapore on December 7 and 8. “Because of the ubiquity of the Internet, as well as the intentional use of this and other technologies to reach the entire world, the geographic reach of the conference is greatly amplified. As a result, BASIS customers and potential customers from the United States, Asia, and other locations throughout the world will be exposed to RIM"s use of the BBX mark at the conference.” says BASIS Chairman and CEO Nico Spence in declaring support of the motion. Spence continues, “BBX’s reputation of platform independence that BASIS has carefully nurtured and promoted for over a quarter of a century is being systematically wiped out by RIM. The extent of the realignment of the world’s media to immediately associate BBX with BlackBerry, and therefore a single platform, is perfectly illustrated by blog entries such as this one from earlier today. Software developers interested in selecting a platform-independent development tool won’t take the time to discover that BASIS’ BBX is not the same as BlackBerry BBX.” BASIS released version 11.11 of BBj, the latest generation of BBX, on 11.11.11. See this newest release in action by running the sample restaurant tip calculator and home mortgage calculator applications from links.basis.com/buidemos to experience BASIS’ BBX platform-independent solutions for yourself on your own smartphone or tablet.

BASIS Files Motion for a Preliminary Injunction Against RIM’s Use of BBX   [TOP]
BASIS Files Motion for a Preliminary Injunction Against RIM’s Use of BBX. ALBUQUERQUE, N.M.--(BUSINESS WIRE)--BASIS International Ltd. today filed a motion for a preliminary injunction against Research in Motion (RIM) to stop using BASIS’ incontestable federally registered trademark BBX® during the pendency of their trademark infringement action against RIM. "BASIS built the BBX brand over the course of a quarter of a century to become synonymous with the term ‘operating system independent’. RIM’s unilateral seizure of that brand to use as a name for their new BlackBerry operating system is destroying that association. It’s absurd to suggest that they are not in our line of business. We provide application development tools for the enterprise, and for desktop and mobile solutions, while RIM is touting their new BBX operating system to application software developers around the world as the linchpin to their strategy for their tablet and smartphone products,” says BASIS CEO and Chairman, Nico Spence.

Confusion about Blackberry using BBX as the new platform   [TOP]
Our CarIT platform provider BASIS International Ltd.- Albuquerque (US) has taken swift legal action to preserve and protect their longstanding ownership of the BBx® trademarked operating system independent language, database, and toolset. Research In Motion’s (RIM) press release announcing a new BlackBerry operating system (OS) named “BBX” is causing great confusion for the worldwide BASIS community and could potentially harm BASIS’ reputation for enabling cross-platform application development.

CarIT making progress in Mexico   [TOP]
Our Partner Audev de Mexico has sold CarIT to a large Nissan dealer group (Automotores De Satelite) and is near completion of the installation at the first dealership location in Mexico City. The group has three Nissan dealerships plus three other make dealerships (Renault and Suzuki). The group sells over 6,000 cars per year. The country specifics have been completed and are running well. The DMS is fully integrated with a Mexican based accounting package. We are currently working with Nissan Mexico to provide all the make specific integrations that Nissan would like to have. As far as I know we are the only DMS to provide a completely integrated European based product in the Mexican market. The Mexican auto market is dominated by dealer groups that not only have multiple locations but usually handle multiple makes, this is ideal for our multi-make design. Mexico has complicated accounting practices so our design of making the DMS independent of the financial back office worked out very well and allowed us to deliver an integrated solution relatively quickly. Our support of multiple languages at the user/customer level is also an asset for those service customers that do not understand Spanish very well and would like their invoices in their native language (there are a lot of American and Canadian retirees in Mexico).

ERP accounting for CarIT DMS   [TOP]
Audev has completed the development and testing of the Navision interface to CarIT DMS. Navision Granules are now available from Microsoft to support the CarIT interface. This integration is available for the World Wide Version of Navision 4.0. Both Batch and Interactive modes are supported in the integration. Advantages: CarIT is dealership operations centric and supports multiple financial packages in a design that is independent of the financial back-end application. The same dealer or group that has multiple Locations and Makes supported by one CarIT DMS system, can install multiple financial packages within this same DMS solution. This provides maximum flexibility for dealers that want to take advantage of ERPs (like Navision) for their larger operations and yet continue to use simpler or more country specific financial packages for some of their dealerships. Since CarIT is not dependent on any one Financial Engine it offers more flexibility. By supporting the latest the Navision ERP we can now offer the CarIT solution to many more parts of the world. Current languages supported by CarIT are English, French, German, Spanish, and Dutch. Language is defined at the user and customer level in the CarIT DMS system ,so multi-lingual deployment is possible.

Summary of “Automotive Retailing and Distribution Event .”   [TOP]
The conference in Amsterdam pointed out some unmistakable trends in your industry: - You will sell more than one brand. - Your retail organizations will have outlets that will have to cover larger market areas. - You will be challenged to keep track of the customer over these multiple sales points and service points. - You will sell cars via new channels. - Future software must be independent of the Platform, independent of the database, not dependent on a single development environment. - Future software must be www-connected and have application service providing facilities. - The application effort put in future software should be preserved even while the overall technology is changing dramatically.
